Helping You Move Forward After Procedural Errors

Cesarean delivery (C-section) is the most common surgery in the United States, and 30% of babies are delivered this way. Unfortunately, the procedure carries risks to both mother and child, especially when it is not performed properly.

If you or your child are injured during a C-section, ‘MAGGIO LAW can help you determine what went wrong. Injuries that could have been avoided may be cause for a birth injury lawsuit.

Why Do Doctors Perform C-Sections?

Your C-section might be planned or performed in an emergency. Doctors plan C-sections when the baby is in a breech (feet-first) or transverse (sideways) position in the womb before labor, when they have certain birth defects, and when the mother has conditions that affect the birthing path (placenta previa, herpes, HIV, etc.). Your doctor is also more likely to plan a C-section if you are delivering multiples or a large baby or you have had a C-section before.

Emergency C-sections are more dangerous and happen when there is a problem with the birth. Your doctor might order an emergency C-section if labor stops or fails to progress, you experience problems with your placenta (placental abruption) or umbilical cord, or your baby is in fetal distress.

Whether your procedure is planned or part of emergency care during labor and delivery, your doctor must perform it according to a pre-determined standard of care. If they make a serious mistake that harms you or your newborn, you may be entitled to compensation.

Risks for the Mother

The #1 risk for mothers during C-sections is bladder injury. Bladder injuries occur when doctors accidentally cut into your bladder during surgery. Doctors may also cut into your bowels. If this occurs, you may need a follow-up surgery and your recovery time could be longer. The effects of this surgical mistake could also last a lifetime.

Other risks mothers face during Cesarean delivery include:

  • Uterine infections (endometritis)
  • Incision infections
  • Postpartum hemorrhage (heavy bleeding during and after birth)
  • Reactions to anesthesia
  • Deep vein thrombosis and pulmonary embolism (blood clots in the legs or pelvic organs and lungs)
  • Scarring and adhesions
  • Complications during future pregnancies
  • Death If you have sustained any of the injuries above or lost a loved one to C-section injuries, please do not hesitate to schedule a free consultation with ‘MAGGIO LAW.

Potential Injuries to the Newborn

Sometimes, doctors inadvertently nick or cut infants while making uterine incisions. These cuts are called fetal lacerations and they can be mild, moderate, or severe. While mild fetal lacerations tend to heal on their own, you may need to speak to a lawyer about moderate to severe lacerations.

Infants who are delivered by C-section may also be delivered prematurely and/or have breathing problems and low APGAR scores.

When your child is scarred or seriously affected by mistakes during C-section, your doctor may be liable for medical malpractice. Get in touch to learn more.
