Mississippi Car Accident Laws
Mississippi follows a "fault" or "at-fault" system, meaning the driver who caused the accident is typically responsible for the resulting damages. This driver and their insurance company may be required to compensate the other party/parties for medical bills, property damage, lost wages, pain, and suffering, etc.
The state also applies the legal principle of "comparative negligence." This means that if more than one party is found to be at fault for an accident, the compensation each party receives is adjusted based on their degree of fault. However, if a plaintiff's negligence exceeds that of the defendant(s), they might be barred from recovering damages.
