Employers in Mississippi Who Must Get Workers’ Comp
Mississippi requires any employer with five or more employees to purchase workers’ compensation insurance. The insurance plan can be purchased through the Mississippi Workers’ Compensation Commission (MWCC ) or from an MWCC-approved insurance carrier. In either situation, the workers’ comp insurance should take effect on the first day of the covered employee’s employment. Independent contractors in Mississippi are generally not covered by workers’ compensation policies. However, just because you are an independent contractor does not mean you should be. Many employers will intentionally misclassify employees as independent contractors for the sole purpose of denying them important benefits, like workers’ compensation coverage.
