Serving Injured Workers in Canton and Across Mississippi

Every 7 seconds, a worker is injured on the job. In 2018, a total of 5,250 workers died as a result of their injuries, and even those who survived workplace injuries struggled with medical costs, missed wages, and lifelong disabilities.

Luckily, when injuries happen at work, workers’ compensation accounts for costs like medical bills and missed wages. In some cases, however, a personal injury lawsuit or wrongful death claim may be more appropriate.

To understand your options and pursue maximum compensation, schedule a free consultation with the Canton, MS workers' comp lawyers at ‘MAGGIO LAW before, during, or after you make a claim.

What Is Workers’ Compensation?

Workers’ compensation is a no-fault insurance plan mandated by the state of Mississippi and paid for entirely by employers. Any business with 5 or more regular employees must provide workers’ compensation insurance to their workers in accordance with state law and the Mississippi Workers’ Compensation Commission (MWCC).

Interfering with the workers’ compensation is a felony and law enforcement, the MWCC, and our firm are all here to help protect your rights.

What Benefits Am I Entitled To?

Injured workers are entitled to 2 basic benefits – medical benefits and wage loss benefits. If an employee dies on the job or as the result of a workplace accident, the decedent’s family may also be eligible for benefits.

  • Medical benefits cover all treatments, appointments, and services you need to achieve maximum cure. These benefits help you get emergency care, doctor’s appointments, physical therapy, crutches, and more – at no cost to you. They also account for transportation to and from your doctor’s office and other related expenses.
  • Wage loss benefits apply when recovering from your injury requires you to miss time at work. While you are out, you should receive up to 2/3 of your regular income for a certain time period set by the state legislature. These are known as “temporary disability payments.”

Once you have achieved “maximum recovery” and are no longer receiving medical care, you may be entitled to “permanent disability” payments if you are still unable to return to work. Like temporary disability payments, these benefits are bound by certain time limits, and you may need to explore social security disability insurance, as well.

Why Do I Need a Lawyer?

In an ideal situation, you will not need a lawyer at all. Workers’ compensation sometimes goes smoothly, and injured workers get the care they need without our assistance. Nevertheless, with all the parties involved, there are several places where the workers’ compensation process can go wrong.

For example, your employer could try to discourage you from making a claim, fail to file your paperwork, or otherwise interfere with your benefits; your insurer could deny your claim, or you could face difficulties dealing with the MWCC.

You are allowed to involve an attorney at any point in the workers’ compensation process. If you want to maximize your chances of approval at the beginning, you can have a lawyer help file your claim. If you need to appeal a denied claim, our firm can help, as well. We are especially talented at working with the MWCC and helping you adhere to all the Commission’s requirements.

When you need us, our team at ‘MAGGIO LAW is here for you.
