What Is A Personal Injury?
The term “personal injury” can be misleading, as it does not describe an injury, but rather, a field of law. Also known as “tort law,” personal injury law aims to “provide relief to injured parties from harms caused by others.” The definition of “tort” is similar to the definition of “negligence,” as both terms indicate an act or omission that injures someone else. Cases of tort are proved by showing negligence.
To prove negligence, the injured party (plaintiff) must show:
- The person who harmed them (the defendant) owed the plaintiff a duty of care
- The defendant breached that duty
- The plaintiff suffered an injury
- The defendant’s breach caused the plaintiff’s injury
While this may seem simple, it can be complex and requires both evidence and skilled advocacy.
