Common Causes of Truck Accidents

Commercial vehicles are larger, harder to control, and more dangerous than passenger vehicles. Any mistake can lead to serious injuries or fatalities. Even a defective windshield wiper blade, for example, could lead to a momentary loss of visibility with devastating consequences.

Some of the most common causes of trucking accidents we see at our firm include:

  • Speeding
  • Tailgating
  • Distracted driving
  • Texting and driving
  • Driving under the influence
  • Driver fatigue (drowsy driving)
  • Improper merging
  • Unsafe lane changes
  • Uneven or excessive loads
  • Poorly maintained vehicles
  • Defective truck parts

All of these behaviors constitute negligence in one way or another. If you’ve been harmed by another’s negligence, you may be entitled to compensation. ‘MAGGIO LAW can help you get it.

Determining Liability in Truck Accidents

In all motor vehicle accidents, the at-fault party or parties can be held liable for any damages that occur. Truck accidents can be especially complex because several parties could be responsible for your accident and injuries.

Our legal team will help you identify all possible points of liability to help you maximize your compensation.

You may be able to sue one or more of the following parties:

  • The truck driver
  • The company that operates the truck (i.e., UPS, FedEx, Waste Management, shipping fleets, and other businesses)
  • The owner(s) of the truck and trailers
  • The owner of the goods being transported
  • The party that loaded the truck

When filing a lawsuit, you may have to work with multiple insurance companies, all of which will want to minimize their liability.

Our Biloxi truck accident attorneys are experienced with these kinds of cases, which means we won’t get lost in complex mazes of ownership, insurance carriers, and liability.

The Service Hour Regulations for Truckers

Service hour regulations for truckers, also known as hours of service (HOS) regulations, are designed to ensure the safety of commercial motor vehicle (CMV) drivers and others on the road by limiting the amount of time a driver can spend behind the wheel without taking adequate rest. These regulations are set by the Federal Motor Carrier Safety Administration (FMCSA) in the United States and may vary in other countries.

The HOS regulations for property-carrying CMV drivers in the United States include the following key provisions:

  • 11-Hour Driving Limit: CMV drivers may drive a maximum of 11 hours after 10 consecutive hours off duty.
  • 14-Hour Limit: CMV drivers may not drive beyond the 14th consecutive hour after coming on duty, following 10 consecutive hours off duty. Off-duty time does not extend the 14-hour period.
  • Rest Breaks: Drivers are required to take a 30-minute break after 8 cumulative hours of driving time.
  • 60/70-Hour Limit: CMV drivers may not drive after 60/70 hours on duty in 7/8 consecutive days. A driver may restart a 7/8 consecutive day period after taking 34 or more consecutive hours off duty.
  • Sleeper Berth Provision: Drivers using a sleeper berth must take at least 8 consecutive hours in the sleeper berth, plus a separate 2 consecutive hours either in the sleeper berth, off duty, or any combination of the two.
  • Electronic Logging Devices (ELDs): Most CMV drivers are required to use ELDs to record their HOS, replacing paper logs.

It's important to note that these regulations are subject to change, and there may be additional state-specific regulations that apply. Additionally, there are exemptions and special provisions for certain types of operations or drivers. Truckers and trucking companies should stay informed about the latest HOS regulations to ensure compliance and promote safety on the roads.

Investigating Your Accident

An in-depth investigation may be the most crucial part of your truck accident claim. Insurance companies arrive at the scene of the accident within hours, and so do we. Our attorneys and investigators can access driver logs to determine hours-of-service violations (the Federal Motor Carrier Safety Administration sets limits for time behind the wheel), gather physical evidence and recreate accidents, and look into a driver’s profile to make sure they have proper training and qualifications.

Without an attorney, you may not have access to this valuable information. That’s why having the right Biloxi truck accident lawyer can make or break your case.

Common Truck Accident Injuries

Truck accidents can result in serious injuries and death. In 2018, more than 4,000 people died in accidents with large commercial vehicles. Even survivors sustain life-changing injuries with alarming frequency.

Common truck accident injuries include:

  • Back and neck injuries
  • Spinal cord injuries (paralysis)
  • Head injuries
  • Traumatic brain injuries
  • Fractures (broken bones)
  • Cuts, scrapes, and bruises
  • Road rash
  • Internal injuries
  • And more

If you or a loved one was injured or killed in a truck accident, we can file a personal injury lawsuit or a wrongful death claim on your behalf.

Damages You Can Recover

While filing a lawsuit won’t change what happened, a successful settlement or verdict can help you recover valuable resources.

Damages in a truck accident may include compensation for:

  • Hospital bills
  • Medical expenses
  • Rehabilitative care
  • Assistive care and devices
  • Missed wages
  • Lost earning potential
  • Pain and suffering
  • Changes to your quality of life
  • And more

You may also be entitled to damages for burial and funeral expenses in wrongful death claims, and in some cases, punitive damages apply. Also called exemplary damages, punitive damages are designed to punish the wrongdoer and make an example of them to discourage similar behavior in the future.

We help you pursue the resources you need to rebuild.
